Terms and conditions of Balade Studio online store:

§1. General Provisions
The subject of these Regulations is to regulate the terms of sale and operation of the Online Store. In accordance with Article 384 of the Civil Code, these Regulations are part of the agreement concluded with the Seller.

Placing an effective Order is possible after accepting the provisions of these Regulations.
The online store sells goods via the Internet, through the store system located on the website www.balade-studio.com/
The owner of the online store registered at www.balade-studio.com is Alicja Leszczyńska and Jessica Adamczyk Bugla conducting business activity under the name: Alicja Leszczyńska Studio Projektowe at Hlouszka 25, 45-772 Opole, registered under the NIP number: 7542994696, REGON: 368564890.
The Buyer may be any natural person, legal person or organizational unit without legal personality, using their own e-mail account and having legal entity entitling them to perform legal acts in accordance with the provisions of the law.

Consumer – should be understood as a natural person purchasing products in the Online Store, within the meaning of art. 221 of the Civil Code.
The provisions of the Act of 30 May 2014 on consumer rights do not apply to entities other than Consumers.
The Parties to the Agreement exclude the Seller’s liability under the warranty for physical and legal defects of the product, in relation to persons and entities that are not Consumers.
The information contained on the Seller’s websites does not constitute an offer within the meaning of Art. 66 of the Civil Code; it constitutes an invitation to conclude an agreement within the meaning of Art. 71 of the Civil Code.
The Seller presents digital photos of the products offered. In addition, it makes every effort to ensure that the presented photos are of the highest quality and reflect the actual condition and colors of the presented products to the greatest extent possible. The details of the products may in fact differ slightly from the designs presented in the online store.
The prices in the Seller’s Online Store are given in Polish zloty (PLN) and are gross values ​​(they include all their components, including the applicable VAT).
The Seller reserves the right to change the prices of products in the product catalog, introduce new products to the Online Store and remove unavailable products, conduct and cancel promotional campaigns on the Seller’s websites and introduce modifications to them.
§2. Orders
Orders are accepted through the store system located on the website www.balade-studio.com/pl/
A distance sales agreement between the Seller and the Buyer is concluded after the correct completion of the purchasing procedure defined in the order form of the store system located on the website www.balade-studio.com/
The Seller is obliged to deliver the Buyer goods free from defects. The Consumer’s obligations under the concluded sales agreement end at the moment of receipt of the goods and payment of the full price, in accordance with these Regulations, subject to the obligations incumbent on the Consumer in the event of a complaint or withdrawal from the agreement. In the event of unavailability of the ordered product, the Buyer is informed of this fact by the Seller within 14 working days and decides on the method of fulfilling the remaining part of the placed order (partial fulfillment, extension of the waiting time for the missing product, replacement of the missing product with another or cancellation of the entire order and refund of the money for the ordered products).

The proof of purchase of the goods is an e-mail confirming the purchase of the product on the website www.balade-studio.com/
The payment for the goods and the cost of delivery of the order are paid via the PayU payment system, online card payments, BLIK, PayPal, Apple Pay.
Payment for the order must be made within 24 hours of placing the order, in the event of non-payment, the order will be canceled.
The delivery of the goods takes place in the manner specified in the order. Parcels are delivered by courier (DPD or inPost) or Paczkomat (InPost). The parcel is sent within a maximum of 14 working days from the posting of the payment to the Seller’s bank account. When paying by card, the order processing time is counted from the moment of obtaining positive payment authorization.
The cost of international shipping is determined individually through the store system.

§ 3 Pre-order

In relation to selected goods, the Seller may enable placing an order in pre-order mode (pre-sale).
The pre-order option applies to goods selected by the Seller that are not available in the Seller’s offer, but the date of their premiere or re-availability is known no later than 28 business days from the introduction of the possibility of placing pre-orders in relation to a specific product.
Goods available in the pre-order formula are clearly marked in the Seller’s Online Store together with the planned date on which the goods will become available.
Pre-order orders have a deferred shipping date until the premiere of the goods or the re-availability of the goods in the Seller’s offer. The order will be sent immediately after the premiere of the goods or the re-availability of the goods in the Seller’s offer, but no later than within 2 days of the occurrence of any of the above events.
2 days before the planned date of the premiere of the goods or the re-availability of the goods in the Seller’s offer, the Seller will remind the Buyer about the placed Order by e-mail if the given Buyer is entitled to a shipment after the specific premiere date or re-availability.

In the event that the Order placed by the Buyer includes both goods ordered in the pre-order mode and in the regular sales mode, the Buyer may decide at their own discretion whether the Order is to be divided into two Orders or delivered in its entirety within the time provided for the delivery of the pre-order Order. In the event of the Buyer’s decision to divide the Order, the Buyer shall cover the delivery costs of each Order independently.
The remaining provisions of these Regulations shall apply accordingly to pre-order orders, to the extent not otherwise regulated in this paragraph.
§4. Complaint about the purchased product

The Seller is liable to the Consumer if the sold item has a physical or legal defect (warranty).
The Seller is exempt from liability under the warranty if: a) the Consumer knew about the defect at the time of conclusion of the contract; b) the Seller is not liable to the Consumer for the fact that the sold item does not have the properties resulting from public assurances, if he did not know these assurances or, judging reasonably, could not have known or they could not have influenced the Consumer’s decision to conclude the sales contract, or if their content was corrected before conclusion of the sales contract. If the sold item has a defect, the Consumer may submit a declaration of a price reduction or withdrawal from the contract, unless the Seller immediately and without excessive inconvenience to the Consumer replaces the defective item with a defect-free one or removes the defect. This limitation does not apply if the item has already been replaced or repaired by the Seller or the Seller has not fulfilled the obligation to replace the item with a defect-free one or to remove the defect. The consumer may, instead of the removal of the defect proposed by the Seller, request the exchange of the item for a defect-free one, unless bringing the item into compliance with the contract in the manner chosen by the consumer is impossible or would require excessive costs compared to the method proposed by the seller. When assessing the excessiveness of costs, the value of the item free from defects, the type and significance of the identified defect are taken into account, as well as the inconvenience to which the consumer would be exposed by another method of satisfaction. The reduced price should remain in such proportion to the price resulting from the contract that the value of the item with the defect remains to the value of the item without the defect. The consumer cannot withdraw from the contract if the defect is insignificant. If only some of the sold items are defective, the consumer’s right to withdraw from the contract is limited to defective items. The complaint statement should include: Name and/or description of the product, order number, data of the complainant (Name and Surname, contact telephone number, e-mail and address), along with a detailed description of the physical defects of the complained goods.
The Seller shall return to the Consumer the costs associated with sending the goods that do not comply with the contract, immediately after considering and accepting the Consumer’s claims under the warranty for defects in the goods.
If it is not possible to repair or replace the goods with new ones, the Seller shall inform the Consumer about a possible exchange for another product with the same parameters.
After receiving the shipment, the Consumer should check it in the presence of the deliverer (courier or representative of the Post Office) and in the event of finding any mechanical damage caused during transport, draw up a protocol signed by the Consumer and the deliverer.
Complaints are considered within 14 business days from the moment the product is delivered to the address provided. If the complaint is considered positively, the Consumer will receive the transfer after 14 business days.

§5. Return and exchange of purchased product

In accordance with art. 27 of the Act of 30 May 2014 on consumer rights, the Consumer has the right to withdraw from the contract within 14 days from the date of issue of the product without giving a reason. In order to meet the deadline for withdrawal from the contract, it is sufficient for the Consumer to send information regarding the exercise of the right to withdraw from the contract before the deadline for withdrawal from the contract expires.
When returning the goods, the Buyer should send the Seller an unequivocal statement of withdrawal from the contract and send the goods in accordance with the following contact details: e-mail: info(at)balade-studio.com
The Consumer needs to send the goods that he wants to return or exchange together with undamaged labels, secured in the original packaging.
In the event of withdrawal from the contract, on the basis indicated in point 1, both the Seller and the Consumer are obliged to return everything they received from the other party under the concluded contract.
The Consumer bears the direct costs of returning the product.
In the event of withdrawal from this agreement, the Seller shall return to the Consumer all received payments immediately, and in any case no later than 14 days from the day on which the Seller was informed of the Consumer’s decision to exercise the right to withdraw from this agreement. The refund will be made using the same payment methods that were used by the Consumer in the original transaction, unless the Consumer expressly agrees to a different solution; in each case, the Consumer will not incur any fees in connection with this refund.

The Consumer, with the Seller’s consent, may exchange the product for another within 14 days from the date of receipt. In such a case, the Buyer should contact the Seller via the e-mail address: info(at)balade-studio.com

In the event of the need to return funds for a transaction made by the customer with a payment card, the seller will make a refund to the bank account assigned to the Ordering Party’s payment card.
The consumer is liable for the reduction in the value of the item resulting from its use in a manner other than necessary to establish the nature, characteristics and functioning of the item. The right to withdraw from the contract does not apply to the consumer in relation to contracts: a) provision of services, if the entrepreneur has fully performed the service with the express consent of the consumer, who was informed before the commencement of the provision that after the entrepreneur has provided the service, he will lose the right to withdraw from the contract; b) in which the price or remuneration depends on fluctuations in the financial market over which the entrepreneur has no control and which may occur before the deadline for withdrawal from the contract expires; c) in which the subject of the provision is a non-prefabricated item, manufactured according to the consumer’s specifications or intended to meet his individual needs; d) in which the subject of the provision is an item that spoils quickly or has a short shelf life; e) in which the subject of the provision is an item delivered in a sealed package, which cannot be returned after opening the package due to health protection or hygiene reasons, if the package was opened after delivery; f) where the subject of the provision are items that after delivery, due to their nature, are inseparably connected with other items; g) where the consumer has expressly requested the entrepreneur to come to him for urgent repair or maintenance; if the entrepreneur additionally provides services other than those requested by the consumer, or supplies items other than spare parts necessary to perform the repair or maintenance, the consumer has the right to withdraw from the contract in respect of additional services or items; h) the supply of newspapers, periodicals or magazines, with the exception of a subscription contract; i) concluded by way of public auction.

§6. Personal data protection

The provision of personal data by the Buyer is voluntary, however, their absence makes it impossible to complete the order. By making a purchase, the Buyer consents to the collection, processing and use of personal data by the Seller for the purpose and to the extent necessary for the Seller to complete the order (i.e. to deliver the parcel to the Buyer and make settlements).
The administrator of personal data is Alicja Pałys-Leszczyńska conducting business under the name: Alicja Pałys-Leszczyńska Studio Projektowe at Hlouszka 25, 45-772 Opole, registered under the NIP number: 7542994696, REGON: 368564890.
The data will be processed in compliance with all security requirements specified in the Act of 29 August 1997. on the protection of personal data (Journal of Laws of 2002, No. 101, item 926, as amended) and in the implementing provisions issued on its basis.
The Buyer has the right to freely access (inspect) their personal data, the right to correct them, as well as the right to demand that their processing be discontinued and that they be removed from the database, which should be reported in writing to the seller at the e-mail address: info@balade-studio.com
The Buyer may consent to receiving promotional and informational materials via e-mail correspondence. This is information thematically related to the activities of the Online Store and messages about special offers.
§7. Final provisions

In the event of any doubts related to purchases in the Online Store – all information is provided by the Seller at the e-mail address: info@balade-studio.com
The law applicable to the assessment of the legal relationship formed on the basis of these Regulations is Polish law.
In matters not regulated by these Regulations, the provisions of the Civil Code and other acts shall apply.

If one of the provisions of these Regulations is deemed invalid or impossible to implement by a final court decision, the remaining provisions shall be valid and remain in force.

The Seller shall make every effort to ensure that any disputes that may arise from the performance of contracts concluded using these Regulations are resolved amicably. In particular, the Buyer may request mediation under the terms described in art. 1831 et seq. of the Code of Civil Procedure.
